Hire Terms & Conditions

These Hire Terms & Conditions apply to bookings made with Giggling Genie for the hire of our Magic Mirrors, Vintage Magic Mirrors, 360 Photo Booths, Selfie Pods and associated equipment and services.

Please read these terms before making a booking.

By paying the Reservation Payment, or the full hire charge where applicable, you confirm that you have had the opportunity to read and agree to these Hire Terms & Conditions.

1. Definitions

In these terms:

“Giggling Genie”, “we”, “us” and “our” means Giggling Genie, the supplier of the equipment and services.

“Customer”, “you” and “your” means the person making the booking.

“Event” means the event for which our equipment or services have been booked.

“Equipment” means the photo booth and any associated equipment, accessories, lighting, printers, backdrops, props, barriers, cables or other items supplied as part of the booking.

“Self-Service Hire” means equipment delivered and installed by Giggling Genie for the customer and their guests to use without a Giggling Genie attendant remaining at the event.

“Attended Hire” means a hire where a Giggling Genie attendant remains with the equipment for the agreed operating period.

2. Booking and Reservation Payment

A booking is not confirmed until Giggling Genie has received the applicable Reservation Payment and confirmed the booking.

The Reservation Payment is:

  • £100 for a Magic Mirror, Vintage Magic Mirror or 360 Photo Booth.
  • £75 for a Selfie Pod.

The Reservation Payment forms part of the total hire price and reserves the agreed equipment and event date.

Until the Reservation Payment is received, quotations and proposed dates remain subject to availability.

By paying the Reservation Payment, the customer confirms acceptance of these Hire Terms & Conditions.

3. Final Balance

The remaining balance must be paid 30 calendar days before the event date.

For bookings made within 30 calendar days of the event, the full hire charge will normally be payable when the booking is confirmed.

If payment is not received by the due date, Giggling Genie may contact the customer and, after giving reasonable notice, may treat the booking as cancelled if payment remains outstanding.

4. Cancellation by the Customer

If you need to cancel your booking, please notify Giggling Genie in writing as soon as possible.

Where cancellation takes place more than 30 calendar days before the event, the Reservation Payment will normally be retained. Any further amount already paid which Giggling Genie is not reasonably entitled to retain will be refunded.

Where cancellation takes place 30 calendar days or less before the event, the full hire price will have fallen due.

Because Giggling Genie has reserved the equipment and date, may have declined other bookings and may have incurred costs in preparing for the event, a substantial proportion of the hire charge may be retained or remain payable.

Any amount retained or charged following cancellation will be reasonable and will take account of the losses and costs caused by the cancellation, any costs Giggling Genie has avoided and our reasonable ability to obtain a replacement booking.

Where Giggling Genie successfully replaces a cancelled booking, this will be taken into account when determining any amount that remains payable or refundable.

Nothing in this section affects any statutory rights the customer may have.

5. Changes and Postponements

If you wish to change your event date, please contact Giggling Genie as soon as possible.

We may agree to transfer a booking to another available date. Transfers are subject to availability and may be affected by changes in price, venue, equipment requirements or other reasonable additional costs.

A requested date change is not confirmed until Giggling Genie confirms it.

6. Cancellation by Giggling Genie

If Giggling Genie has to cancel a booking and cannot provide the agreed service or a suitable alternative accepted by the customer, payments made for the affected service will be refunded.

Nothing in these terms limits any additional rights or remedies available to the customer under applicable law.

7. Venue Access

The customer is responsible for giving Giggling Genie accurate information about access to the venue and the intended equipment location.

You must tell us in advance about anything that could affect delivery, installation or collection, including:

  • stairs or steps;
  • lift access or lift restrictions;
  • narrow doors, corridors or access routes;
  • long distances between parking/loading areas and the setup location;
  • restricted parking or loading;
  • security procedures;
  • restricted setup or collection times;
  • uneven or unsuitable surfaces; or
  • any other unusual or difficult access conditions.

Telling us about an access issue does not automatically mean that the proposed access is suitable. Giggling Genie must be able to assess whether the equipment can be transported and installed safely.

If equipment cannot safely or reasonably be delivered or installed because significant access restrictions were not disclosed to us, this will not normally entitle the customer to a refund.

Reasonable additional costs resulting from undisclosed access problems may be charged to the customer.

8. Venue Requirements

The customer is responsible for ensuring that the venue permits the booked equipment and provides sufficient suitable space.

Where electricity is required, the venue must provide a suitable and safe mains power supply.

The customer should check any venue requirements or restrictions before booking.

Giggling Genie may refuse to install or operate equipment where we reasonably consider the proposed location, access or conditions unsafe.

9. Self-Service Hire

Giggling Genie will normally deliver, position, install and test Self-Service Hire equipment before handing it over to the customer or another responsible person.

Responsibility for taking reasonable care of the equipment begins when it has been installed and handed over and continues until Giggling Genie retakes possession.

Equipment must remain in the agreed position unless Giggling Genie has expressly authorised it to be moved.

Customers and guests must not dismantle, open, modify or attempt to repair equipment.

If a problem occurs, please contact Giggling Genie rather than attempting repairs yourself.

10. Collection of Self-Service Equipment

The customer must ensure that Giggling Genie can access the venue and equipment at the agreed collection time.

If we cannot collect because access is unavailable, the venue is closed or the equipment cannot be reached, the customer remains responsible for taking reasonable care of the equipment until Giggling Genie can recover it.

Reasonable costs resulting from a failed or additional collection may be charged.

11. Loss and Damage

Customers must take reasonable care of Giggling Genie equipment.

The customer may be responsible for the reasonable repair or replacement cost where equipment is lost or damaged because of:

  • misuse;
  • negligence;
  • deliberate damage;
  • unauthorised movement or interference;
  • theft;
  • loss; or
  • failure to take reasonable care.

Customers are not responsible for normal wear and tear or equipment faults occurring through no fault of the customer or their guests.

Giggling Genie does not normally require a separate damage/security deposit.

12. Magic Mirror and Vintage Magic Mirror

Magic Mirrors must only be used in accordance with instructions provided by Giggling Genie.

Because of their size, weight and construction, customers and guests must not attempt to reposition or move a Magic Mirror or Vintage Magic Mirror after installation unless Giggling Genie has expressly authorised this.

Where a Vintage Magic Mirror is provided as a Self-Service Hire, the Self-Service Hire provisions in these terms also apply.

13. Selfie Pods

Selfie Pods will normally be supplied on a Self-Service basis unless the booking states otherwise.

Digital photographs are the standard Selfie Pod service unless another service or add-on is specified in the booking.

Where post-event printed photographs have been purchased as an add-on, they will be produced after the event and supplied to the customer separately.

On-site instant printing is only included where expressly stated in the customer’s booking.

Optional equipment and accessories are only included where specified in the quotation or booking confirmation.

14. 360 Photo Booth

The 360 Photo Booth must be operated in accordance with Giggling Genie’s safety instructions.

Guests must follow instructions given by the Giggling Genie attendant.

We may pause or stop use where we reasonably believe continued operation presents a safety risk.

Giggling Genie will determine the safe number of people permitted on the platform at any one time.

15. Children’s Parties

Children using or approaching Giggling Genie equipment must be supervised by a responsible adult.

Children must not climb on, pull, move or interfere with the equipment, cables, lighting or accessories.

Children’s party hires are provided on a Self-Service basis as specified in the booking.

Where a Vintage Magic Mirror package includes printed photographs, these may be produced at the end of the hire rather than continuously throughout the party.

Selfie Pod hire is digital as standard. Where post-event prints have been purchased as an add-on, they will be produced after the event and supplied separately.

Giggling Genie will not use photographs or videos showing children taken during a children’s party for advertising, social media, website content or any other marketing purpose.

We may photograph the equipment or setup where appropriate, provided no children or other identifiable people appear in those photographs.

16. Customer and Guest Behaviour

Customers are responsible for ensuring that their guests use the equipment appropriately.

Food and drinks must be kept away from electrical equipment.

Customers and guests must not climb on, deliberately damage, interfere with or misuse equipment.

Giggling Genie will not tolerate threatening, abusive or unsafe behaviour towards our staff.

During an Attended Hire, we may pause or end the service where customer or guest behaviour creates a genuine safety risk or our staff are subjected to threatening or abusive behaviour.

During a Self-Service Hire, we may recover equipment early where we reasonably believe there is a significant risk of damage, theft or unsafe use.

Where a service has to be stopped because of the actions or behaviour of the customer or their guests, a refund will not normally be due, subject to applicable consumer law.

17. Equipment Failure

Giggling Genie takes reasonable steps to maintain and test its equipment.

Technology can occasionally fail.

If a fault occurs, we will make reasonable efforts to restore the service or, where reasonably possible, provide suitable replacement equipment.

If a significant part of the booked service cannot be provided because of equipment failure attributable to Giggling Genie, an appropriate remedy will be provided having regard to the extent of the service that could not be supplied.

If the affected booth/service fails completely and cannot reasonably be repaired or replaced, any contractual refund will normally be limited to the amount paid for that affected service, subject to any liability or remedy which cannot legally be excluded or limited.

18. Internet and Digital Sharing

Some digital-sharing features depend upon internet or mobile connectivity.

Giggling Genie cannot guarantee the availability or quality of internet or mobile services at a venue.

Lack of venue connectivity does not by itself constitute equipment failure.

Where technically possible, photographs that cannot be shared during the event because of connectivity problems may be made available afterwards.

19. Printing

Where printing is included in an Attended Hire, Giggling Genie will make reasonable efforts to maintain printing throughout the agreed operating period.

If printing cannot be restored during the event, photographs may, where reasonably possible, be produced afterwards and supplied to the customer.

For Self-Service Hire, printing arrangements will be those stated in the customer’s booking.

20. Power and Venue Services

Where mains power is required, the customer/venue must provide a suitable and safe electricity supply.

Giggling Genie is not responsible for service interruptions caused by venue-wide power failures, venue internet/mobile connectivity problems, deliberate disconnection of equipment or other venue services outside our reasonable control.

21. Photographs and Digital Files

Photographs and videos created using Giggling Genie equipment may be processed and temporarily stored as necessary to provide the booked service, including producing prints, supplying digital photographs and providing online galleries.

Customers are responsible for making their guests aware that photography is taking place.

Guests who do not wish to participate should not use or pose for the photo booth.

Personal information and event images are handled in accordance with the Giggling Genie Privacy Policy.

22. Online Galleries

Where an online gallery is provided by Giggling Genie, it will be password protected.

The gallery password will normally be provided to the customer.

The customer is responsible for deciding who they share the password and gallery access with.

Galleries are intended for private viewing and downloading and are not a permanent photo-storage service.

Online galleries will normally remain available for approximately 30 days.

Customers should download and securely save any photographs they wish to keep during this period.

Giggling Genie cannot guarantee permanent availability or storage after the gallery period has ended.

23. Marketing Use of Images

Acceptance of these Hire Terms & Conditions does not automatically give Giggling Genie permission to use identifiable customer or guest photographs for marketing.

Where we wish to use identifiable photographs for advertising, website content, social media or other promotional purposes, appropriate permission will be obtained separately where required.

Photographs or videos showing children taken during a children’s party will not be used by Giggling Genie for marketing purposes.

24. Privacy

Giggling Genie handles personal information in accordance with its Privacy Policy and applicable UK data-protection law.

The Privacy Policy explains what information we collect, why we use it, how long it may be retained, who it may be shared with and the rights individuals have regarding their personal information.

25. Circumstances Outside Our Reasonable Control

Giggling Genie will not be responsible for failure or delay caused by circumstances outside our reasonable control.

These may include severe weather, accidents, significant road closures, venue closure, power failure, emergency restrictions or other events which could not reasonably have been prevented.

If this occurs, we will make reasonable efforts to communicate with the customer and find an appropriate solution.

Nothing in this section affects rights or remedies which cannot legally be excluded.

26. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms removes or restricts the customer’s statutory consumer rights.

Subject to those rights, Giggling Genie will not be responsible for losses that were not reasonably foreseeable when the contract was entered into.

Where lawful and appropriate, liability relating to the failure of a particular booked service will normally be limited to the amount paid for that affected service.

27. Consumer Rights

Nothing in these Hire Terms & Conditions is intended to remove or restrict rights provided to consumers by applicable UK law.

Certain services relating to leisure activities supplied for a specific date or period may be exempt from the standard statutory cancellation period applicable to some distance contracts.

Nothing in these terms removes a statutory cancellation or refund right where one applies.

28. Changes to These Terms

The Hire Terms & Conditions applying to a booking are those provided or made available to the customer when the contract is entered into.

Giggling Genie may update its Hire Terms & Conditions from time to time. Changes will apply to future bookings and will not retrospectively alter an existing booking unless agreed with the customer or required by law.

29. Governing Law

These Hire Terms & Conditions and the contract between Giggling Genie and the customer are governed by the laws of England and Wales.

Nothing in this section removes any consumer right concerning the court or jurisdiction in which a claim may legally be brought.

30. Acceptance of These Terms

Customers must be given the opportunity to read these Hire Terms & Conditions before making their Reservation Payment.

By paying the Reservation Payment or, where applicable, the full hire charge, the customer confirms that they have had the opportunity to read these terms and agrees to them.
