Giggling Genie Photo Booths respects your privacy and is committed to protecting your personal information.

This Privacy Policy explains what information we collect, why we collect it, how we use and protect it, how long we keep it, and your rights regarding your personal information.

1. Who We Are

Giggling Genie Photo Booths is the trading name of Linda Payne, sole trader, providing photo booth hire and related event services.

For the purposes of UK data protection law, Linda Payne trading as Giggling Genie Photo Booths is the data controller responsible for the personal information we collect and process in connection with our business.

2. Information We May Collect

Depending on how you contact us and the services you use, we may collect:

  • your name;

  • email address and telephone number;

  • billing or contact address where required;

  • event date, venue and other information about your event;

  • information you provide through our website enquiry or quotation forms;

  • correspondence between you and Giggling Genie;

  • booking and payment records, including records of payments made by bank transfer or through our third-party card payment provider;

  • photographs, GIFs and videos created when our photo booth equipment is used;

  • contact information voluntarily entered into our equipment where a guest chooses to use a digital sharing feature;

  • information necessary to provide prints, digital photographs or access to an online gallery; and

  • limited technical information about visits to our website, including information collected through cookies and website analytics where applicable.

We do not collect or store customers’ full payment card details.

We aim to collect only the personal information reasonably necessary to respond to enquiries, manage bookings, provide our services and operate Giggling Genie.

3. How We Collect Information

We may collect personal information when you:

  • submit an enquiry through our website;

  • request a quotation or proposal;

  • make a booking;

  • contact us by telephone, email, WhatsApp, messaging service or social media;

  • communicate with us before, during or after an event;

  • use one of our photo booths or Selfie Pods;

  • choose to use a digital sharing feature to receive a photograph, GIF or video;

  • request prints or access to an online gallery; or

  • visit and interact with our website.

We may also receive limited personal information from an event organiser, venue, company, school, parent or other person arranging an event at which we provide our services.

Where someone provides us with another person’s personal information, they should only do so where they are authorised to provide that information.

4. How We Use Your Information

We may use personal information to:

  • respond to enquiries and requests for information;

  • prepare and send quotations and proposals;

  • process, manage and fulfil bookings;

  • communicate with customers about their event;

  • arrange delivery, setup and collection of photo booth equipment;

  • provide the photo booth service booked;

  • create and provide photographs, GIFs, videos and prints where included in the service;

  • provide digital sharing and online gallery access where applicable;

  • produce and post photographs after an event where post-event printing has been purchased;

  • maintain booking and payment records;

  • provide customer service and deal with questions, complaints or problems;

  • maintain appropriate business, accounting and tax records;

  • protect our equipment and legitimate business interests;

  • operate, maintain and improve our website and services; and

  • comply with our legal and regulatory obligations.

We will only use personal information for purposes that are reasonably connected with the reason it was collected, unless we have a lawful reason to use it for another purpose.

We do not sell personal information.

5. Our Lawful Basis for Using Personal Information

Under UK data protection law, we must have a lawful basis for using personal information. The lawful basis will depend on why we are using the information.

We may rely on:

Contract – where using your information is necessary to respond to steps you ask us to take before making a booking, or to manage and provide the services you have booked.

Legal obligation – where we need to use or retain information to comply with a legal requirement, including appropriate tax and accounting records.

Legitimate interests – where using information is reasonably necessary to operate and protect Giggling Genie, administer enquiries and bookings, provide customer service, maintain appropriate business records, prevent misuse of our services or improve our services, provided your rights and interests do not override those interests.

Consent – where we ask for your permission for a particular use of your personal information, including certain marketing uses of identifiable event photographs where appropriate.

Where we rely on consent, you may withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of anything we did before consent was withdrawn.

6. Photographs, Videos and Photo Booth Content

When guests choose to use our photo booth equipment, photographs, GIFs, videos or other digital content may be created as part of the service booked by the customer or event organiser.

Depending on the service booked, this content may be:

  • displayed on the photo booth during the event;

  • printed during or after the event;

  • made available to the guest through a digital sharing feature;

  • supplied to the customer or event organiser who booked the service; or

  • made available through an online gallery.

Guests are not required to use the photo booth equipment and participation is voluntary.

Where an online gallery is provided, it will normally remain available for approximately 30 days after the event to allow customers and guests reasonable time to access and download their photographs.

Giggling Genie does not routinely retain a permanent archive of all event photographs. Event photographs and other digital content will normally be deleted after the applicable gallery and service period has ended.

Selected photographs may be retained for longer where they are being used for Giggling Genie marketing or promotional purposes, subject to Section 8 of this Privacy Policy.

Photographs from children’s parties will not be retained for Giggling Genie marketing or promotional purposes.

Additional safeguards relating to children’s photographs are explained in Section 7.

7. Children’s Parties and Children’s Images

We take particular care with photographs and personal information relating to children.

Where Giggling Genie provides equipment for a children’s party:

  • photographs, GIFs and other content created using the equipment are provided solely as part of the service booked;

  • photographs or videos from children’s parties will not be used by Giggling Genie for advertising, social media, website content or any other marketing or promotional purpose;

  • where an online gallery is provided, it will be password protected;

  • gallery access details will normally be provided to the parent, guardian or person who booked the event; and

  • event photographs and other digital content will normally be deleted after the applicable gallery and service period has ended.

For self-service children’s party hires, the parent, guardian or responsible event organiser is responsible for supervising children’s use of the equipment.

Giggling Genie will not knowingly use contact information entered by a child into our equipment for marketing purposes.

Our photo booth services are provided to the person who books or organises the event. They are not intended as an online service offered directly by Giggling Genie to children.

8. Marketing and Use of Event Images

Giggling Genie may occasionally wish to use selected photographs or videos from suitable events to demonstrate and promote our photo booth services on our website, social media or other promotional material.

Booking or using a Giggling Genie photo booth does not automatically give us permission to use an identifiable guest’s photograph or video for marketing purposes.

Where an identifiable person is the main subject of a photograph or video that we wish to use for marketing, we will obtain appropriate permission before publishing it.

Giving permission for marketing use is optional and will not affect a customer’s booking or the service they receive.

Where we rely on consent, that consent may be withdrawn at any time by contacting info@gigglinggenie.com. We will stop using the relevant image for future marketing and remove it from marketing material under our control where reasonably practicable.

Selected photographs or videos for which appropriate marketing permission has been obtained may be retained for as long as they remain reasonably required for that purpose. We will periodically review our marketing material and remove content that is no longer required.

Giggling Genie will not use photographs or videos from children’s parties for advertising, website content, social media or any other marketing or promotional purpose.

9. Reviews and Testimonials

Customers may choose to leave reviews about Giggling Genie on third-party platforms such as Google or social media.

Reviews posted directly by customers on third-party platforms are published and managed through the relevant platform and are subject to that platform’s own privacy policies and terms.

Giggling Genie may respond publicly to reviews posted about our services. When responding, we will take reasonable care not to disclose private booking, contact or event information that has not already been made public by the reviewer.

We may occasionally reproduce or share a customer review or testimonial on the Giggling Genie website, social media or other promotional material.

Where a review has already been made publicly available by the customer, we may quote or share the review for the purpose of promoting our services where it is reasonable and appropriate to do so. We will take care not to include unnecessary personal information.

Where appropriate, we may identify the reviewer using their first name, initials or the name they have publicly used with the review.

If a customer has provided a testimonial directly to Giggling Genie for promotional use, we will use it for the purpose for which it was provided.

If you would like us to stop using a review or testimonial that we have reproduced in marketing material under our control, please contact info@gigglinggenie.com. We will consider the request and, where appropriate, remove it from future use and from material under our control where reasonably practicable.

Deleting Giggling Genie’s internal customer or booking records does not automatically remove a review that a customer has independently published on a third-party platform.

10. Online Galleries and Digital Sharing

Depending on the service booked, guests may be able to receive photographs, GIFs or videos through digital sharing features provided by our photo booth equipment and software.

Where a guest chooses to use a digital sharing feature, they may be asked to provide information such as an email address or mobile telephone number so that the requested content can be delivered.

Contact information entered for this purpose will be used to provide the requested digital content and will not be added to Giggling Genie’s marketing list or used by us for unrelated marketing purposes.

Digital sharing may be provided using specialist third-party photo booth, communications or gallery services acting on our behalf.

Event photographs, videos and associated event information will normally remain within the photo booth software we use for approximately 30 days after the event. This allows us to provide galleries, downloads and reasonable post-event support.

Where an online gallery is provided, it will also normally remain available for approximately 30 days after the event.

After this period, Giggling Genie normally deletes the event from the photo booth software, removing the event and associated guest sharing data from our active event records.

Selected photographs retained for authorised Giggling Genie marketing purposes are dealt with separately under Section 8.

For children’s parties, any online gallery provided by Giggling Genie will be password protected, with access details normally supplied to the parent, guardian or person who booked the event.

Customers and guests should only enter their own contact information into a digital sharing feature, or information they are authorised to use.

11. Sharing Personal Information and Service Providers

Giggling Genie does not sell, rent or trade personal information.

We may share or process limited personal information using trusted third-party service providers where this is reasonably necessary to operate our business or provide the service booked.

These may include:

  • photo booth software, digital sharing and online gallery providers;

  • website hosting and website service providers;

  • email and communications providers;

  • payment providers;

  • accounting and administrative service providers;

  • cloud storage and data backup providers; and

  • other technology providers necessary to operate our services.

Card payments are currently processed using Stripe. Where a customer chooses to pay by card, payment and related information required to process the transaction is provided to Stripe. Giggling Genie does not collect or store customers’ full payment card details.

Stripe processes personal information in accordance with its own privacy and data protection arrangements.

We only provide or permit access to personal information where reasonably necessary for the relevant service.

Where a third-party provider processes personal information on our behalf, we expect them to handle that information appropriately and in accordance with applicable data protection requirements.

Some service providers may process personal information under their own privacy policies and legal responsibilities.

We may also disclose personal information where required by law, to comply with a legal or regulatory obligation, or where reasonably necessary to establish, exercise or defend legal rights.

We do not provide customer or guest personal information to third parties for their own unrelated marketing purposes.

12. International Data Processing

Some of the third-party service providers we use, including software, cloud, communications, gallery and payment providers, may process or store personal information outside the United Kingdom.

Where personal information is transferred outside the UK, we will take reasonable steps to ensure that the transfer is made in accordance with applicable UK data protection law and that appropriate safeguards are in place.

These safeguards may include recognised data protection arrangements, contractual protections or other lawful transfer mechanisms.

Where a third-party provider processes information under its own privacy policy and legal responsibilities, its own international data transfer arrangements may also apply.

13. How Long We Keep Information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet our legal, accounting and business obligations.

Different types of information may therefore be retained for different periods.

Event photographs and photo booth data

Event photographs, videos, guest sharing information and associated event data will normally remain within our photo booth software for approximately 30 days after the event. After this period, the event will normally be deleted, subject to any selected photographs retained with appropriate permission for marketing purposes as explained in Section 8.

Customer and booking records

Customer and booking records will normally be retained for up to 6 years after the event for reasonable business administration, customer service, reference and to assist returning customers who choose to hire Giggling Genie again.

After this period, records that are no longer reasonably required will be deleted or anonymised unless we have another lawful reason or legal obligation requiring us to retain them.

Financial and accounting records

Booking, invoice and payment records may be retained for the period required to meet our tax, accounting and other legal obligations.

Enquiries that do not result in a booking

Information relating to enquiries that do not result in a booking will be retained only for a reasonable period for follow-up and administration and will then be deleted when it is no longer required.

Information may be retained for longer where reasonably necessary in connection with a complaint, dispute, legal claim or legal obligation.

14. Keeping Your Information Secure

Giggling Genie takes reasonable technical and organisational measures to protect personal information against unauthorised access, accidental loss, misuse, alteration or disclosure.

Access to customer, booking and event information is limited to those who reasonably need it to operate the business and provide our services.

Where we use third-party software, payment, gallery, communications or other service providers, we take reasonable care to use reputable providers and appropriate security arrangements.

Where an online gallery is provided for a children’s party, it will be password protected as described elsewhere in this Privacy Policy.

Customers and guests are responsible for keeping any gallery passwords or access details provided to them secure and should not share them with people who are not intended to have access.

Although we take reasonable steps to protect personal information, no electronic storage, internet transmission or online service can be guaranteed to be completely secure.

15. Cookies and Website Analytics

The Giggling Genie website uses cookies and similar technologies to help the website operate, understand how visitors use the site and improve our website and services.

Some cookies are necessary for the website to function correctly. Other cookies, including analytics cookies, may be controlled through the cookie consent options provided on our website.

We currently use Google Analytics 4 (GA4) to help us understand how visitors interact with our website. Google Analytics may collect information about website usage, such as pages visited, approximate location, device and browser information, and how visitors arrived at our website.

Information collected through Google Analytics is used to understand website performance and visitor behaviour and to help us improve the Giggling Genie website and our services. We do not use Google Analytics information to personally identify individual customers.

Our website provides cookie controls that allow visitors to accept, deny or manage applicable cookie preferences.

16. Your Data Protection Rights

Under UK data protection law, you have rights regarding your personal information. Depending on the circumstances, these may include the right to:

  • ask us for copies of personal information we hold about you;

  • ask us to correct information that is inaccurate or incomplete;

  • ask us to delete your personal information in certain circumstances;

  • ask us to restrict how we use your personal information in certain circumstances;

  • object to certain uses of your personal information;

  • ask us to transfer certain personal information to you or another organisation where applicable; and

  • withdraw your consent at any time where we rely on consent to use your information.

Not all of these rights apply in every situation, and in some circumstances we may have a legal reason to continue holding or using certain information.

Making a complaint to Giggling Genie first does not affect your right to contact the ICO.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our services, technology, business practices or legal and regulatory requirements.

When we make changes, the latest version will be published on the Giggling Genie website and the Last Updated date at the top of the Privacy Policy will be revised.

We recommend checking this Privacy Policy occasionally if you would like to know whether it has changed.
